Welcome to Papaya Wadi Shaam. These Terms govern your use of our website and online store and your purchase of the products and services available through them, collectively referred to as the “Services.”

Our store is powered by Shopify, which enables us to provide the Services. “We,” “us,” and “the Store” refer to Papaya Wadi Shaam. “You” refers to a website visitor or customer.

By using the website or placing an order, you agree to these Terms and the Privacy Policy, Return and Refund Policy, and Shipping Policy published on the Store. If you do not agree, please do not use the Services.

1. Eligibility

You must have reached the legal age of majority or use the Store with the supervision and permission of your parent or legal guardian.

You are responsible for providing accurate information, protecting your account credentials, and all activity conducted through your account.

You must not use the Store for an unlawful or fraudulent purpose or in a manner that infringes another person’s rights.

1. Products

We aim to display accurate product information, photographs, and prices. However:

• The color, texture, and shape of papaya pieces can naturally vary between containers.
• Colors might appear differently depending on your screen.
• Product photographs are for presentation, and the selected option and container label determine the applicable size and net weight.
• Product availability and quantities may change without notice.
• Adding a product to the cart does not reserve it.

We may change product descriptions or availability or discontinue products, provided that this does not affect an accepted order except as permitted by law.

1. Food Products and Allergies

You must read the label, ingredients, storage instructions, and expiry date before consuming a product.

If you have a food allergy or medical condition, please confirm that the ingredients are suitable before purchasing or consuming the product. Contact us if you need additional information.

Information on the Store is not medical or professional dietary advice, and the products are not intended to diagnose, treat, cure, or prevent disease.

Products must be stored and used according to their labels. To the extent permitted by law, we are not responsible for deterioration caused by improper storage, leaving a container open, or using unclean utensils after delivery.

1. Accuracy of Claims

Statements such as “100% natural,” “no preservatives,” or other nutritional claims apply only when accurately displayed on the relevant product’s label.

If a website description conflicts with mandatory information on the container, contact us before use. This paragraph does not remove our responsibility for misleading descriptions or non-conforming products.

1. Orders and Acceptance

Submitting an order is an offer to purchase the selected products. An order receipt notification is not final acceptance.

An order is accepted when we confirm preparation or dispatch, or deliver it to you, whichever occurs first.

We may refuse or cancel all or part of an order for a legitimate reason, including:

• Insufficient inventory.
• An obvious pricing or description error.
• Failed or unverifiable payment.
• Reasonable suspicion of fraud or abuse.
• Inability to deliver to the supplied address.
• A violation of law or these Terms.
• A technical error that caused the order to be accepted incorrectly.

If we cancel a paid order before fulfilment, we will return the eligible amount to the original payment method. This does not necessarily apply when a correctly prepared and dispatched order is refused, subject to our Refund Policy and applicable law.

1. Quantity Limits and Resale

We may limit the quantity of a product that can be purchased, particularly when inventory is limited.

Products are intended for personal use. You must not commercially resell them or use our trademarks or images for marketing without prior written permission.

Please contact us before placing a wholesale or commercial order.

1. Prices and Taxes

Prices are displayed in United Arab Emirates dirhams unless stated otherwise.

Delivery charges and applicable taxes are displayed before payment. We do not impose additional charges that were not disclosed.

We may change future prices without notice, but a change will not affect an accepted order except in the case of an obvious pricing error.

If an incorrect price is published because of a human or technical error, we may contact you to confirm the correct price or cancel the order and return the payment.

Discounts and promotions must not be used contrary to their terms or combined unless expressly permitted.

1. Payment

You must provide accurate payment information that you are authorized to use.

Payments are processed by Shopify or external payment providers and may be subject to the relevant provider’s terms and privacy policy.

An order may be held until payment is successfully completed and verified. Customers remain responsible for amounts properly due.

1. Delivery

Delivery charges and estimated delivery times are displayed during ordering or in our Shipping Policy.

Delivery times are estimates and may be affected by weather, road conditions, delivery companies, or circumstances outside our control. We will attempt to notify you of a material delay where reasonably possible.

You must provide an accurate address and telephone number and arrange for someone to receive the order.

Additional delivery charges may apply if delivery fails because of:

• An incorrect address or telephone number.
• Failure to answer the delivery company.
• The recipient’s absence at the agreed time.
• A request to change the address after dispatch.
• Refusal to receive a correct and conforming order.

Responsibility for safeguarding the product passes to the customer when it is delivered to the customer or their designated recipient.

1. Order Inspection

You should inspect the quantity, sizes, and condition of the containers upon delivery.

If a product arrives damaged, leaking, or inconsistent with the order, contact us as soon as possible, preferably within 24 hours, and provide the order number and requested photographs.

Our published Return and Refund Policy applies to return, replacement, and refund requests.

1. Returns and Refunds

Because our products are food products, we do not accept returns of conforming products because of a change of mind or taste preference, to the extent permitted by law.

Completed delivery fees are non-refundable unless otherwise required by law.

Damaged, defective, or incorrect products are handled in accordance with our Return and Refund Policy and mandatory consumer rights.

1. Order Cancellation

You may request cancellation before preparation or dispatch begins. Cancellation cannot be guaranteed after fulfilment has started.

If an order has been dispatched, completed delivery fees and costs already incurred might not be refunded, to the extent permitted by law.

1. Promotions and Discount Codes

Promotions and discount codes are subject to their advertised validity period and conditions.

We may cancel a discount or related order when a code is used fraudulently or without authorization, or because of an obvious technical error.

Discount codes cannot be exchanged for cash, sold, copied, or used after expiry.

1. Accounts, Reviews, and Submissions

Information published in a review or comment must be truthful and relate to your genuine experience.

You must not publish content that:

• Is false, misleading, defamatory, threatening, or unlawful.
• Infringes privacy or intellectual property rights.
• Contains malware or unsolicited advertising.

We may, but are not required to, review and remove content that violates these Terms or applicable law.

When you send us a review or image for publication, you grant us a non-exclusive licence to use and display it for Store and marketing purposes unless otherwise agreed in writing. We will not sell a personal photograph of you to another party.

1. Intellectual Property

Our trademarks, logos, photographs, designs, text, and Store content are protected by intellectual property rights.

They must not be copied, altered, republished, or used commercially without prior written permission, except for ordinary personal use of the website.

Using the Store does not transfer ownership of our trademarks or content to you.

1. Prohibited Uses

You must not:

• Use the Store for fraud or provide false information.
• Attempt unauthorized access to accounts or systems.
• Disrupt the Store or introduce malicious code.
• Collect or copy customer information without authorization.
• Impersonate another person.
• Abuse discounts, payments, or refund procedures.
• Use our content or brand in a manner suggesting a partnership that does not exist.

We may suspend access or cancel orders connected to a violation, subject to applicable law.

1. Third-Party Services and Links

The Store may contain services or links provided by Shopify, payment providers, delivery companies, social media platforms, or other third parties.

We do not own or control every third-party service. Your use of those services is subject to the relevant provider’s terms and policies.

To the extent permitted by law, we are not responsible for the content or practices of an external website that we do not operate.

1. Privacy

Personal information is processed according to the Privacy Policy published on the Store.

When using Shopify services or an external payment provider, certain information may be processed by that party under its own policies.

1. Disclaimer

We provide the Services and products in accordance with their descriptions and any warranties required by law.

We do not guarantee that the website will always be uninterrupted or error-free and may temporarily suspend it for maintenance or technical reasons.

To the extent permitted by law, we provide no additional warranties that are not expressly stated. We are not responsible for consequences arising from use contrary to instructions, use after expiry, or improper storage after delivery.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

1. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss or loss of profit resulting from use of the Store or a product.

To the extent permitted by law, our total liability relating to a particular order will not exceed the amount actually paid for the affected order.

This limitation does not apply to fraud, gross negligence, personal injury for which liability cannot legally be excluded, or mandatory consumer rights.

1. Customer Responsibility

You are responsible for direct and reasonable damage caused by your intentional violation of these Terms, unlawful use of the Services, or infringement of another party’s rights, to the extent permitted by law.

This section does not require you to compensate us for damage caused by our own fault or violation of law.

1. Force Majeure

We are not responsible for delay or failure caused by circumstances reasonably outside our control, including natural disasters, severe weather, road closures, system outages, government action, or disruptions to payment and delivery services.

We will attempt to minimize the effect and notify customers if orders are materially affected.

1. Termination

You may stop using the Services at any time.

We may suspend an account or restrict access where there is a material breach, fraudulent activity, or a security risk. Obligations arising before termination remain effective.

1. Severability and Waiver

If part of these Terms is unenforceable, it will apply to the maximum extent permitted by law, and the remaining provisions will continue in effect.

A delay in exercising a right does not waive that right.

1. Entire Agreement

These Terms, together with the Privacy Policy, Return and Refund Policy, Shipping Policy, and advertised promotion terms, form the agreement governing use of and purchases from the Store.

1. Changes to These Terms

We may update these Terms for operational, legal, or security reasons. We will publish the revised version and change the “Last updated” date.

Changes apply to future use and orders from publication and do not retroactively change an order already accepted unless required by law.

1. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates and applicable local laws in the Emirate of Ras Al Khaimah.

We encourage you to contact us first so that we can attempt to resolve a complaint amicably. If a resolution cannot be reached, the competent authorities, committees, and courts will have jurisdiction in accordance with applicable law, without prejudice to mandatory consumer rights.
